Due Diligence

Due Diligence is defined as using the level of judgment, care, and prudence, that a person would reasonably be expected to do prior to a specific event. For corporations needing to make important business decisions, Due Diligence means "checking it out", i.e. acquiring objective and reliable facts and information about a subject before finalizing their decision.

The "subject" of the due diligence for corporations may be the merger or acquisition of another business, the investment of monies with another business or individual, the evaluation of a start up company, or as simple as checking out an employee before making the decision to hire.

The reasonable and prudent level of care in any of the above situations would certainly involve a thorough investigation of the company and the principals involved with the company and/or any individuals relevant to the decision at hand.


Claims Investigations

Technology has led the way to the substantial growth of the investigative profession. Thanks to computers,
useful and even critical information is available from all parts of the country with lightning speed. However, when it comes to determining the credibility of humans, whether they are lying or telling the truth, we often have to resort to the "old fashioned" method of observation. Especially in cases involving claims of soft tissue injury, when there is no objective medical evidence or other facts to support a claim, watching and filming a claimant's activities can "shed light" on the credibility of the claim.

Case Histories: "A Little Goes a Long Way"

Case #1

Mr. X claimed he couldn't drive a car due to injuries. Shortly before the trial, he was filmed driving. When confronted with this evidence, he claimed that it was a "one time" excursion. The jury didn't buy it and awarded zero in damages. The client had offered to settle this case for $100,000 prior to the trial. Cost to the client for this surveillance -- only $2,500.

Case #2

Ms. X claimed she was bedridden and could no longer work in her garden. She was filmed for approximately 20 minutes doing yard work in her front yard. When her case went to trial, the film was enough to convince the jury that her injuries were grossly exaggerated! They awarded a total of $2,000 in damages to the plaintiff. She had been asking for hundreds of thousands! Total cost of surveillance to the client: only $2,800.

Red Flags of a Questionable Claim

- Claimant is never home to answer the phone or is “sleeping and cannot be disturbed.”

- Injury coincides with layoffs, a plant closing, or a slow down in the economy affecting the claimant’s income.

- Leads from co-workers suggest that the subject is active; i.e. golf, soccer, hobbies, musical performances, childcare, volunteer work.

- No organic basis for disability. Subjective medical information supplied.

- Claimant has a history of self-employment and/or is a tradesman (carpenter, electrician, mover, etc.) who might readily work for cash while feigning disability.

- Excessive demands for compensation.

- Rehab reports indicate a healthy-looking claimant, portraying mixed symptoms or behaviors.

- Claimant receives mail at a post office box or parent's residence and will not divulge the actual address of his/her residence.

- Claimant has moved out of city or state.

- Disability beyond that normally associated with claimed injury.

- "Dueling Doctors" - one says the claimant is disabled, the other disagrees.

- Claimant gives a cell phone number instead of residence number.

- Has numerous past claims, the "Frequent Flyer" employee.
